1. Terms and Conditions of Booking
1.1 This Agreement ("Agreement") does not constitute a contract of car rental. The car rental services ("Rental Services") will be provided under a separate rental agreement to be concluded with the company AutonoleggioPrime that will provide the vehicle ("Local Renter ") and the person that request the service (the "Customer"). The customer will be subject to the standard conditions of a AutonoleggioPrime on fitness to drive.
1.2 For booking of the pre-paid online service, the customer concludes this Agreement with AutonoleggioPrime (please see the terms and conditions of the pre-paid online service described below).
1.3 For booking of the post-paid service, the customer concludes this Agreement with the Local Renter (please see the terms and conditions of the post-paid service listed below).
1.4 The Customer acknowledges and agrees that any contractual relationship between the Customer and the Local Renter in relation to the Rental Services will be established only upon collection of the vehicle by the customer and will be subject to the law of the country in which the vehicle is rented by the customer.
1.5 The Customer acknowledges that the rented car can move only in the following countries: Austria, Belgium , Denmark, France, Germany, Italy, Luxembourg, Netherlands, Norway, Portugal, United Kingdom, Spain, Sweden and Switzerland.
It's also allowed the movement of the cars in Croatia and Slovenia, with the exclusion of Large Station Wagons, Executives, Luxurys and 4x4s cars. It's strictly prohibited transit and delivery the cars rented from AutonoleggioPrime in the following countries: Albania, Belarus, Bosnia, Bulgaria, CIS (former USSR ), Estonia, Finland, Greece, Herzegovina , Latvia, Lithuania, Macedonia, Poland, Czech Republic, Slovakia, Romania, Russia, Serbia, Ukraine, Hungary.
1.6 In the event of failure by the Customer of the prohibitions referred to in paragraph 1.5, AutonoleggioPrime will be forced , in case of theft or destruction of the vehicle, under any circumstance occurred, to charge to the Customer the full market price of the vehicle. In the circumstance of having to make any repairs to the car, as a result of damage caused by accident, or every other mechanical damage, AutonoleggioPrime will charge the Customer for the full cost of repair, including labor, shelter, transportation for the return and practice management, beyond a reasonable charge for loss of earnings because of the technical downtime.
1.7 AutonoleggioPrime and the Local Renter will not in any way responsible for price changes resulting from the application of laws that affect the rate of VAT and airport/rail taxes.
2. Terms and conditions of the Pre-Paid Online Service
2.1 By clicking "I accept" during the booking process, the customer ends only this Agreement with AutonoleggioPrime and remains bound by its terms and conditions. With the conclusion of this Agreement, the Customer agrees to purchase a voucher to AutonoleggioPrime of nominal value for the amount of the rate quoted by AutonoleggioPrime. AutonoleggioPrime issue the voucher, that will be provided to the Customer by e-mail and will book the Rental Services. The customer can use the voucher to pick up the vehicle from the Local Renter.
2.2 The Customer undertakes to pay the full amount indicated on the voucher by credit card and / or debit card or bank transfer to be able to use the Rental services requested at the time of booking on our website. The voucher will not be issued until the full amount has been paid..
2.3 The voucher purchased by the Customer will be delivered and can be used to rent the vehicle chosen by the Customer for the dates he/she has booked, along with other items specifically included in the price at the time of booking. The customer can view these items by clicking on " Your quote includes " in the "Quote" area of the website.
2.4 Any other optional equipment and services (eg , special equipment, additional drivers, optional insurances, fuel, additional rental days) is subject to additional prices that must be paid directly to the Local Renter when th customer pick up or return the vehicle. Additional charges may be applied by the Local Renter if the Customer is less than 21 years old.
2.5 In case of cancellation of the booking, AutonoleggioPrime will charge the customer an amount of 25 euros (or 50 euros for vehicles of AutonoleggioPrime). AutonoleggioPrime will refund the amount previously charged to the customer for the voucher, apart the above amount for the cancellation.
2.6 If the customer fails to pick up the vehicle within 24 hours from the date and time indicated in the reservation, AutonoleggioPrime will charge to him/her an amount for the non-collection of 95 euros (or 200 euros for vehicles of AutonoleggioPrime). AutonoleggioPrime will refund the amount previously charged to the customer for the voucher, apart the above amount for the non-collection.
2.8. No refunds will be paid by AutonoleggioPrime if :
a) the customer does not use the entire period booked;
b) the Customer modifies its reservation, and its amount, by placing a new reservation whose amount is less than the amount paid for the original booking.
3. Changing Reservations
3.1. If other vehicles are available, the customer can change his/her booking, up to 24 hours before the date of pick up through this site, or up to the start time of the rental by calling AutonoleggioPrime at the (0039 ) 0923 972 306. Subject to the following conditions, the customer can use the voucher for the payment of such alternative services.
3.2. The booking changes are subject to the following conditions:
a) if the Customer modifies its reservation and the amount of the new Rental Services, calculated with the actualized rates in use by AutonoleggioPrime, is higher than the nominal amount of the voucher, the customer will be charged for the difference and this difference must be paid at the time of the change.
b ) if the amount of the new booking is less than the nominal amount of the voucher, the customer will not be refunded.
4. Terms and conditions of the post-paid rental service (pay at the rental office)
4.1 By clicking " I accept" during the booking process, the customer conclude only this Agreement with the Local Renter and remains bound by its terms and conditions. The Rental Services will be subject to a separate rental agreement to be concluded with the Local Renter.
4.2 If the Customer does not cancel the booking before the date and time indicated in the reservation or he/she does not pick up the vehicle within 24 hours from that time, an amount of € 40, £ 40 or 60 CHF (depending on the country where the rental take place, excluding any applicable tax) will be charged to the customer as refund for the Local Renter.
4.3 The customer reservation constitutes a bind also for the Local Renter. If the Local Renter fails to satisfy the customer's reservation for any reason, a refund will be paid by the Local Renter to the Customer.
4.4 In the event that the customer is charged for failure to cancel due to the occurrence circumstances beyond one's control or any act of God (such as earthquakes, floods, hurricanes, acts of terrorism, acts of government or other public authority, wars, riots, insurrections, embargoes or general strikes), the Customer could request a refund of the payed amount by providing appropriate documentation to the Local Renter of the occurrence of such circumstances.
5. Changing reservations for the post-paid service
5.1 If other vehicles are available, the customer can change his/her booking up to the start time of the rental through this site or by calling AutonoleggioPrime at the (0039 ) 0923 972 306.
6.1. No provision of this Agreement can, in any way, derive the cusotmer of the rights established by the laws in matter of refunds.
6.2 . AutonoleggioPrime or the Local Renter will be liable for losses incurred by the Customer arising from the non-fulfilment of the terms of this Agreement, if and only if such losses are foreseeable consequences of the non-fulfilment. Losses are considered foreseeable if the Customer, AutonoleggioPrime or the Local Renter are aware of the failure consequences at the time when the booking is made.
AutonoleggioPrime or the Local Renter are not liable for any consequential damages or further loss that occur as a result of the non-fulfilment by either the customer or by AutonoleggioPrime or the Local Renter (such as loss of profits or loss of opportunity).
The limitations of liability set out in this Article 4.2 shall not apply to the cases provided by art. 1229 of the Civil Code.
